A sixth-plate daguerreotype of James B. Yates, seated at a desk in three-quarter view, survives with an inscription on the back of the plate reading "Sect. of the Senate in 1857." The Library of Congress catalogs it among the American Colonization Society records, which the society organized in 1817 to resettle Black Americans in Liberia. The photographer is unidentified, but the plate was later shown in an exhibition of work by Augustus Washington, a Black daguerreotypist. Yates was born in 1838, so the inscribed office would have been held at roughly nineteen, a detail worth weighing against the title.
